CONTRACT: Health, neuter, and training contract

Contract must be signed and returned within seven days of taking delivery of the
puppy (call before faxing). Failure to comply will render any Health Guarantee Null
and Void.  Payment for a puppy being delivered to the owner will be construed as full
agreement with this contract.

Health        
Seller hereby guarantees that said dog  to be healthy at time of sale, has a Florida
health certificate signed by a licensed veterinarian and has received appropriate
vaccinations and worming(s).   Residual worms, behavioral problems and tear-
staining are not considered in this agreement to be  indicators of bad health.    
Hereditary defects which clinically impact the dog's quality of life are considered in
this contract to be indicators of bad health.
If this dog is found to have a hereditary defect which impacts clinically on its quality
of life by the age of eighteen months, as certified by a qualified veterinarian at buyers
expense, the Seller has the right to require a second opinion from a nominated
veterinarian of Seller’s choice at the Buyer's expense.  If the dog is euthanized or in
any way disposed of, without a second opinion from the Seller's veterinarian the
Buyer waives all rights to a replacement puppy or to any financial payment as
compensation.       
All veterinarians must adhere to the following procedures during the initial
examination and the Seller’s second opinion examination of defects of the dog.        
Identification
  •       ISO Micro chip scanned and recorded.
  •       DNA Sample taken, sealed and certified, forwarded to the seller.
Notification
  •       The Buyer must supply to the Seller a veterinarian's report indicating
    possible hereditary defects within seven days of making the first written
    complaint to the Seller.
  •       A copy of all available reports must be forwarded to the Seller for review by
    the Seller’s veterinarian.
  •       The Seller will review the reports and advise if a second opinion is required
    and if it is,  the Seller will nominate a second veterinarian to whom the dog must
    be taken for further examination, or \  X-rays and/or reports and reserves the
    right to have all veterinary reports, X-rays and other tests forwarded  to the
    Seller for further review by such  other parties as  the Seller may determine and
    at the cost of the Seller
Result
  •       The Seller will make available all results from the second opinion  to the
    buyer at which point the following options  may be available if the dog is
    certified to the Seller’s satisfaction  to have a hereditary defect  clinically
    impacting on its quality of life.  

1.The Seller will replace with a puppy/dog of equal or greater value of the Seller's
choosing OR reimburse to the Buyer the purchase price, not including shipping
costs, upon the above requirements having been met, and upon the return of the live
puppy in question.  The Buyer will pay shipping expenses, including cost of health
certificate and crate for both the returned puppy and the replacement puppy.  It is
understood that there may not be a replacement puppy available at the time of
requested replacement. The replacement puppy will be deemed unconditional
satisfaction of the terms of the contract.  No guarantee other than a state-mandated
health certificate will be provided on the replacement puppy. The Seller is given
twelve months from the date of Seller's agreement to replace the puppy to act upon
this guarantee.       

Or        

2. If the Buyer wishes to keep the puppy, then upon the above requirements having
been met, the Seller will reimburse the Buyer's medical expenses for treatment of the
congenital defect ONLY up to and not exceeding one half of the purchase price of
the puppy, not including shipping costs. It is understood that "reimburse" is defined
as the seller giving up to and not exceeding one half of the cost of the original sale  
price of the dog  (not including shipping) back to the buyer.

Shipping
  • The buyer is responsible for picking up the puppy from Trinity Oaks Farm. If
    the buyer has visited the puppy, the buyer can arrange shipping of the puppy
    at the buyer's expense.  However, Florida travel is the BEST way to choose,
    purchase, and take delivery of a puppy. And we require a meeting with the
    adoptive family in person before shipping. Combining a meeting and pickup of
    the puppy with a Florida vacation is an excellent option! Buyer bears all costs
    relating to the sale of the animal including transportation. The risk of loss or
    injury of the above described animal is on the Buyer at all times after the animal
    leaves the seller.
Re-homing
Buyer agrees that if at any time the Buyer wishes to destroy or give away the dog,
Buyer will first give the Seller every opportunity to help in re-homing the dog, which
must not be destroyed, or relinquished to a pound or shelter.  If the dog dies for any
reason during the first two years, a veterinary report verifying death and cause of
death must be supplied to the Seller.  Failure to comply with these provisions will
render any guarantee null and void.  If the Buyer sells the dog to a third party, this
guarantee is null and void.

Additional Buyer responsibility
Buyer agrees to keep the dog current with all vaccinations and wormings, have a
microchip installed in the dog withing the first month of ownership, feed the dog
properly with high quality dry dog food, adequately exercise and socialize the dog
and keep the dog indoors or in a fenced yard with adequate and appropriate dog
housing, shade, and clean fresh water.
Buyer guarantees that the Buyer and puppy will complete a certified basic
behavioral training course of a minimum of 8 hours duration before the puppy
reaches nine months of age.
Buyer guarantees to neuter the puppy prior to seven months of age. Buyer agrees to
pay Seller $5,000.00 if this provision is not adhered to by the time the puppy reaches
seven months of age. Buyer will provide proof of neutering to the Seller by the time
the puppy reaches seven months of age.  Proof will consist of a letter from the
licensed veterinarian who performed the neutering, on office stationary,confirming
the neutering and positively identifying the puppy by microchip or tattoo.
Seller will
provide CKC litter slip, if requested, upon receipt of proof of neutering.

Buyer agrees that failure to adhere to any of these buyer responsibilities shall render
the puppy guarantee null and void.  Buyer agrees that Buyer's failure to adhere to
any Buyer responsibility in this contract will obligate the Buyer to surrender the
puppy to the Seller with no compensation to the Buyer.  Costs of surrendering and
transporting the puppy will be born by the Buyer.

Definition
The warranty set forth in this contract is the sole warranty and is given in lieu of any
and all other warranties, expressed or implied, including warranties of
merchantability and fitness for a particular purpose.  The Buyer’s sole remedy is
under the warranty provision of this contract and the Seller disclaims and will not be
liable for any other damages including consequential damages, property damage,
emotional distress, loss of use, business interruption or veterinary fees unless
specifically set forth in this warranty provision. This contract sets forth the entire
agreement between the Seller and Buyer and any inconsistent oral terms have no
effect on this contract.   If there is any dispute or litigation between the Seller and
Buyer, the prevailing party will be entitled to reasonable attorney’s fees and costs
not to exceed the purchase price of the Trinity Oaks Toy Labradoodle puppy in
question.
